Pitfalls and the law
What can go wrong with store content.
A guide on your store’s site is advertising for your products. These are the rules worth knowing in the US and the EU. This isn’t legal advice; if in doubt, ask your lawyer.
Health claims
In the US, a supplement may say how a nutrient supports the body (a structure/function claim) only if the claim is substantiated, and on the label it needs the FDA’s disclaimer. Saying it diagnoses, treats, cures or prevents a disease is off limits for supplements. A guide in your store is advertising too, so hold it to the same standard. Selling into the EU? There, only health claims the EU has authorized are allowed.

The FTC’s Green Guides warn against broad, unqualified claims like “green” or “eco-friendly”. In the EU, since September 27, 2026, generic environmental claims without recognized excellent environmental performance are banned, and so are product claims of being climate neutral based on carbon offsetting.

If your guide compares competitors, the comparison has to be accurate: in the US, the Lanham Act lets competitors sue over advertising that misrepresents their products or yours. In the EU, comparative advertising may not present goods as imitations or replicas of trademarked products (Directive 2006/114/EC). Still, “perfume dupes” gets 5,400 searches a month in the US.
