Pitfalls and the law

What can go wrong with real estate content.

Guides, area pages and market reports on your website are advertising for your brokerage. These are the rules worth knowing in the US. This isn’t legal advice; if in doubt, ask your broker or a lawyer.

Fair Housing in area guides

Under the Fair Housing Act, no statement or ad about selling or renting a home may indicate a preference or limitation based on race, color, religion, sex, handicap, familial status or national origin. HUD’s rule (24 CFR 100.75) covers words, phrases and photos that convey a home isn’t available to a group. Phrases like “perfect for young couples” or “no kids” can do that. Describe the home and the area, not who should live there.

A true picture, kept current

If you’re a REALTOR®, Article 12 of the Code of Ethics requires a true picture in all advertising. Standard 12-8 asks you to keep your website current, and 12-10 rules out misleading images and content by others used without attribution or permission. Market numbers from last year and photos from someone else’s listing are the usual problems. Plan to share contacts from your downloads with partners? Standard 12-11 says you have to disclose that.

Outdated commission claims

Since August 17, 2024, offers of compensation to buyer agents can no longer appear on the MLS, buyers sign a written agreement before touring, and REALTORS® must disclose that commissions are not set by law and are fully negotiable. A guide that still calls 6% “standard” or says “the seller always pays” is out of date.

Co-marketing with lenders

Co-branded guides, webinars or ads with a lender or title company are common. Under RESPA Section 8, nobody may give or accept a fee, kickback or thing of value for referring settlement business on a federally related mortgage loan. If a partner pays more than the market value of what it gets, regulators can treat the excess as a referral payment. Split costs by actual share and document it.
